All Parties Present.
The foregoing, having been considered by the Court, is hereby:
The motion for temporary injunction is denied without prejudice. The plaintiff's request, consistent with the evidence introduced at the hearing, is limited to an order prohibiting the defendant from entering any of the plaintiff's stores in Connecticut. At the close of the proceedings the defendant represented in open court and on the record that he would not return to the plaintiff's place of business in Stamford or to any of the other stores where the plaintiff does business in Connecticut for any reason unless he prevailed in a separate civil action referred to in the transcript. Based on the defendant's representation and the evidence introduced at trial the court finds that a temporary injunction is unwarranted and unnecessary to maintain the status quo at the present time. If the defendant conducts himself in a manner that is not consistent with his representation that he would not return to any of the plaintiff's Connecticut stores the plaintiff may file a motion to reopen the evidence on this matter and introduce evidence of such conduct
along with a transcript of this proceeding. In such event the court will reconsider its ruling.
